Constitutional jurisdiction: Some basic theoretical issues, international experience and applicability to Vietnam

The 10th National Delegate Congress of the Party affirmed that it is necessary to “build, accomplish the inspection, supervision mechanism for constitutionality and legality in the activities and decisions of the public authorities” and “build the judgement mechanisms for constitutional violations in legislative, executive and judicial activities”. Thus, it can be affirmed that the constitutional protection requirements have become an urgent requirement in our legal life. In the past years, the constitutional protection in the power enforcement mechanism in our country was implemented through the comprehensive leadership of the Party, the supreme supervision mechanism of the National Assembly, verification, inspection mechanism for the legal normative documents, mechanism for inspecting and solving complaints, denunciations of the citizens. However, the efficiency of the constitutional order protection through these mechanisms is very limited. The basic cause is that there have not been the correct and full and consistent awareness of the requirements of the constitution due to the lack of official explanation of constitution fully and regularly.

The establishment of constitutional jurisdiction in our country must have a scaled, serious and careful research because it requires the re-awareness of the state power enforcement mechanism in our country at present. Therefore, the authors include the scientists: Prof. DSc. Dao Tri Uc, Prof. Dr. Nguyen Dang Dung, Assoc.Prof. Dr. Nguyen Nhu Phat, Assoc.Prof. Dr. Bui Xuan Duc, Assoc.Prof. Dr. Pham Huu Nghi, Assoc.Prof. Dr. Dinh Ngoc Vuong, Assoc.Prof. Dr. Truong Dac Linh, Assoc.Prof. Dr. Le Minh Thong, Assoc.Prof. Dr. Nguyen Duc Minh, Dr. Bui Nguyen Khanh , MA. Bui Ngoc Son, MA. Nguyen Thi Hung, MA. Le Phuong Hoa compiled this book on the basis of the result of the scientific research theme performed by the Institute of State and Law. The book aims to contribute to clarify the issue that what role does the constitutional jurisdiction have in maintaining and protecting the state of law regime and democracy; What trends are the constitutional jurisdiction model in the world developing according to; What constitutional jurisdiction model is in accordance with the political - legal, social and economic conditions of Vietnam.
