Some basic theoretical and practical issues on Constitutional amendment in Vietnam at present

The Constitution is a political – legal document that shows the nature, progress of the state and the regime. The Constitution is the political life organization document of the country, adjusts the mainstay social relations of the country, lays the foundation for a nation, is the basis of the law system of the state, and stipulates the social relations related to the state apparatus organization. Therefore, the constitution construction and amendment is the task of the nation.

The Constitution 1992 (as amended, supplemented in 2001) has been applied in the practice. From that to now, our country has had many changes, especially in economy - society, so this Constitution should be studied, reformed and supplemented. In the Political Report of the 10th Central Committee of the Party at the 11th National Party Congress stated: “Promptly study, amend and supplement the Constitution 1992 (as amended, supplemented in 2001) in accordance with the new situation”. Accordingly, the 13th National Assembly, at the first session, established the draft Constitutional Amendment Committee. The current Constitutional reform is a topical theme attracting the interest of the society.

The book is a monograph for finding out about the actual state of the Constitution 1992, the challenges set by the time of the Constitution and propose the ideas for Constitutional amendment in the coming time. The book content not only provides the scientific foundations contributing to studying, discussing, proposing viewpoints, contents, as well as techniques for amending, supplementing the current Constitution, but also is the useful reference for those who are interested in learning about the field of Constitutional Law.

The book is the result of scientific cooperation between Konrad-Andenauer-Stiftung (KAS Institute of the Federal Republic of Germany) and the Institute of State and Law (under Vietnam Academy of Social Sciences).
