Scientific Forum: The legal issues related to Chinese action of putting oil rig Haiyang Shiyou – 981 in Vietnam’s exclusive economic zone

On 23rd May 2014, Institute of State and Law, a unit member of Vietnam Academy of Social Sciences (VASS), held a scientific forum on “The legal issues related to Chinese action of putting oil rig Haiyang Shiyou – 981 in Vietnam’s exclusive economic zone”. Prof. Dr. Nguyen Xuan Thang, member of the Party Central and President of VASS; Assoc. Prof. Dr. Nguyen Nhu Phat, Director of Institute of State and Law; and Dr. Le Mai Thanh, Chief Editor of State and Law Reviews are the co-chairs of Forum.

There are representatives from specialized research units of VASS, Ministry of Foreign Affairs,Ministry of Justice's,Vietnam Union of Science and Technology Associations, and Vietnam Bar Federation to participate in the Forum. Prof. Dr. Nguyen Xuan Thang delivered an opening speech for the Forum.    

There are four reports presented in the Forum: The 1st report is “Overview of the South China Sea claims” by Dr. Nguyen Hung Son, Vice director of East Sea (South China Sea) Studies - Ministry of Foreign Affairs; the 2nd report is “Evaluation of China’s behaviors in the South China Sea Acts and the illegal action of putting oil rig Haiyang Shiyou– 981 in Vietnam’s exclusive economic zone” by Dr. Nguyen Dang Thang, Viet Nam's sovereign boundaries. The National Boundary Commission - Ministry of Foreign Affairs; the 3rd report is “Legal and diplomatic basis applied in Chinese illegal action of putting oil rig Haiyang Shiyou– 981 in Vietnam’s exclusive economic zone” by Dr. Hoang Ngoc Giao, Institute for Research on Policy, Law and Development - Vietnam Union of Science and Technology Associations; the 4th report is “The methods and procedures to sue China’s illegal action of putting oil rig Haiyang Shiyou – 981 in Vietnam’s exclusive economic zone” by Dr. Le Mai Thanh, Chief Editor of State and Law Reviews.  

After all the reports presented and commented, the representatives lively discussed and exchanged on contents mentioned in reports and related legal issues.

All the representatives highly agreed that there are different legal basis to conclude the violation of China and it is also possible to sue China to international public and tribunal.
