That is honour for the conference to have attendance of Prof. Dr. Vo Khanh Vinh, Vice President of VASS cum Director of Graduate Academy of Social Sciences; Assoc. Prof. Dr. Nguyen Duc Minh, Director of Institute of State and Law; Assoc. Prof. Dr. Nguyen Nhu Phat, former Director of Institute of State and Law as well as representatives and scientists from the National Assembly's Legislation Committee; Ministry of Industry and Trade; Hanoi Law University; Faculty of Law, Vietnam National University, Hanoi; Graduate Academy of Social Sciences; and cadres, officials, civil servants from Institute of State and Law.
After 30 years of innovation, Vietnam has achieved tremendous achievements. Of the key factors that contribute to the achievements, it is necessary to mention role of state and law, social sciences in general and legal sciences in particular. So, research, synthesis and evaluation of situation, research results within the country about state and law for over 70 years establishment of the country, especially essential in the period of 30 years innovation for contributing to affirmation of role of scientific research on State and law.
In the opening speech and the introduction report at the conference, Assoc. Prof. Dr. Nguyen Duc Minh stressed that research on legal theoretics and practices is an urgent issue in the context of that the country are continuing to strengthen building legitimate State, practice and promotion of democracy, development of market economy and international integration. According to suggestion from Assoc. Prof. Dr. Nguyen Duc Minh, the conference content focused on three main issues as follows:
(1) Discovery, clarification of theoretical and practical issues that are happening or may arise in the process of innovation, development, as well as opportunity, challenge, requirement of life that impact, affect legislation in order to resolve and provide scientific arguments for legalization and organization of implementing legal policy.
(2) Analysis, evaluation, clarification of limitation, existence, and cause of restriction, restraint on process of building legitimate State and improving the legal system in Vietnam today.
(3) Identification of issues, subjects, research direction on state and law in the periods of from current until 2020, and from 2020 to 2030.
From the 3 above contents, the conference was divided into 2 sessions:
Session 1: Urgent issues of building legitimate State, sovereignty of the people, State power, democracy and human rights (Assoc. Prof. Dr. Nguyen Duc Minh and Assoc. Prof. Dr. Nguyen Nhu Phat as chairmen)
Session 2: Urgent legal issues in conditions of legitimate State, market economy and international integration (Assoc. Prof. Dr. Nguyen Duc Minh and Dr. Le Mai Thanh as chairpersons)
On behalf of the Academy’s leadership, Vice President Vo Khanh Vinh highly appreciated and supported an initiative by the leaders of Institute of State and Law on organization of the conference with contents and approach as mentioned by Director Nguyen Duc Minh. Professor Vo Khanh Vinh stated and suggested issues of urgent research needed to be conducted, such as:
(1) Innovation of thinking in study of state and law. It is necessary to research in a direction of multidisciplinary, interdisciplinary; bind tightly between theoretics and practices; domestic research is associated with global and regional context.
(2) Research on State: study of the people's sovereignty and implementation of the people's sovereignty, sovereignty of the State in relation to democracy, human rights, civil society, and in the context of globalization, regionalisation; Issue of state power in legitimate state (implementation mechanism of state power, control of political power and state power; Role, function of state in relationship to a market economy, civil society, and in conditions of globalization and regionalisation, relationship among state, market, law and democracy; national governance in a modern and professional direction; prevention and combat of corruption, and international integration,...).
(3) Research on Law: To promote study of role, value, function of law; Developmental trend of world and Vietnam laws; Vietnam’s legal policy; Jurisdictional, legal culture; Summary, evaluation of legal training programme at all levels in Vietnam; Theoretical and practical research in implementation of law, putting law into life and maintaining actual efficiency of law.
On the basis of suggestion from Prof. Dr. Vo Khanh Vinh, the participants at the Conference shared Prof. Vo Khanh Vinh’s opinion, ebulliently discussed and analyzed urgently theoretical and practical aspects of different topics of legal science. The comments were under agreement of that it is necessary to strengthen theoretical research on state and law; provided scientific arguments in terms of perspective and policy to serve making and implementing line, policies and legislation. However, the research needs to bind with actual life within the country and in the world.
The participants also discussed together, shared opinions about urgent issues of law such as: Role, function, value and source of law in the conditions of legitimate state, socialist-oriented market economy, and international integration; Adjustment effectiveness of legislation; Law on solving social issues arising in process of development, legal basis and mechanism to resolve social conflicts, legal basis of generating social consensus as well as other topics about implementation of democracy and human rights, commercial legislation, civil legislation, administrative legislation, criminal legislation...
The scientists also discussed, spoke about issues of law in international integration such as: impact of globalization, regionalisation, bilateral and multilateral commitments (the TPP, the ASEAN economic community, the new free trade agreement with EU, South Korea ...) on state, and way, scope, content of adjustment and implementation of law; National sovereignty in terms of integration, globalization and regionalisation; Mechanism of implementing law in condition of integration today...
The conference is a useful science forum for scientists to exchange, discuss urgently theoretical and practical issues of State and law, and open toward issues, topics, research directions for the periods from current to 2020 and from 2020 to 2030. Not only that, but also the subject of the Conference has particularly important meaning in conducting research on ideology, opinion of the 12th National Congress of the Communist Party, contributing to clarification of developmental orientation of research for the Institute of State and Law as well as jurisprudence of the country in the next time.
